NOTICE OF PUBLIC HEARING
TO WHOM IT MAY CONCERN:
You are hereby notified that the City Council of the City of Cresco, Iowa, will hold a Public Hearing on the 17th day of March 2025, in Council Chambers at City Hall. At this meeting the Council will conduct a public hearing, discussion and action on a request to vacate a portion of F Street located between 3rd Street SW and Vernon Road located in the irregular survey of the East Half (E ½) of the Northeast Quarter (NE ¼) and in the Southwest Quarter (SW ¼) of the Northeast Quarter (NE ¼) of Section 27, Township 99 North, Range 11 West of the 5th P.M. in Howard County, Iowa.
This hearing will be conducted during a regular Cresco City Council Meeting starting at 5:30 pm.
Any resident of Cresco wishing to be heard concerning the reasons for or objections to the amendment, must appear at said hearing and voice your opinions.

NOTICE OF PUBLIC HEARING FOR REZONING
You are hereby notified that the City Council of the City of Cresco, Iowa, will hold a Public Hearing on the 17th day of March, 2025, in Council Chambers at City Hall. At this meeting, the Council proposes to amend provisions pertaining to zoning regulations for the M-1 Light Industrial District.
This hearing will be conducted during the regular Cresco City Council Meeting starting at 5:30 pm
March 17, 2025.
Any resident of Cresco wishing to be heard concerning the reasons for, or objections to, the proposed changes to the zoning Code, must appear at said hearing and voice your opinions in person or in writing.

MINUTES
Mayor Fortune called the Cresco City Council meeting to order on March 17, 2025 at 5:30 pm. Council Members Carman, Bouska, Fosaaen, McConnell, and Kriener were present. No council members were absent.
Carman made the motion to approve the consent agenda which included approval of the: agenda; claims; minutes from the March 3, 2025 meeting; minutes from the March 11th and 12th special meetings. Bouska seconded and it passed all ayes.
Public Works Director Brenno reported: (a) had a water main break on Vernon Rd and one on 8th St E; (b) Street Department has started sweeping streets; (c) the retention basin at the pond is working as it was intended; (d) still swapping out water meters; (e) work at the sewer department for the Aging Equipment Project has not started yet, but should in the next few weeks.
Police Chief Ruroden had nothing to report.
City Clerk Hill reported: (a) monthly financials were included in the packet. We are 66% of the way into the fiscal year and revenues are at 55% and expenditures are at 47%; (b) the proposed tax hearing will be on April 7th at 5:15 pm with the regular meeting at 5:30 pm; (c) the community survey for the comprehensive plan is still open. We have received about 300 completed surveys. Paper copies in English and Spanish are available at City Hall; (d) special yard waste pickup will be March 24th.
Fosaaen reported that the Theatre Commission is busy with fundraising for the Scene Shop Project.
Mayor Fortune asked for comments from the audience. Dave Leitz requested a stop sign be placed at the intersection of 3rd St E and 6th Ave E to slow traffic down. Brenno and Ruroden will analyze the intersection and make a recommendation at a future meeting.
Scott Huneke from WHKS reported on the 7th Street West Reconstruction Project. There are just a few items left to finish up the project and anticipate being able to accept the project this spring. Kriener made the motion to approve Pay Request #10 for $55,421.50 to Generation X Construction, LLC for the 7th Street West Reconstruction Project. Fosaaen seconded and it passed all ayes.
Mayor Fortune opened the public hearing to vacate a portion of F Street located between 3rd St SW and Vernon Rd. There were no written or oral comments and the public hearing was closed. Bouska made a motion to approve the resolution providing for the vacation of a portion of F Street. Carman seconded and it passed all ayes.
Mayor Fortune performed the first reading of Ordinance No. 520 vacating a portion of F Street. Bouska made a motion to approve the first reading. Carman seconded and it passed all ayes.
Carman made a motion and Kriener seconded to waive the second and third readings of Ordinance No. 520. Kriener, McConnell, and Carman voted aye. Bouska and Fosaaen voted nay. Because this motion requires 75% of the full council (4 votes) to pass, this motion failed.
Mayor Fortune opened the public hearing for proposed Ordinance 521 pertaining to zoning regulations for M-1 Light Industrial. There were no written or oral comments and the public hearing was closed.
Mayor Fortune performed the third reading of proposed Ordinance 521 amending Chapter 165.24 of the Code of Ordinances of the City of Cresco, Iowa, pertaining to zoning regulations. Carman made the motion to approve the third reading of proposed Ordinance 521. Bouska seconded and it passed all ayes.

Breno explained that the yard waste site has been locked due to a fire and illegal dumping. Hot ashes were placed in the tree pile which caused a fire. There have also been prohibited items dumped at the site such as treated lumber, plastic pots, furniture, concrete, and garbage. Ryan Henry expressed concerns about having access to the yard waste site by key available only during business hours. He stated that this does not work for working residents. Jackie Fish recommended installing additional cameras to make it easier to identify people who are disposing unauthorized items or not city residents. Kelly Quam proposed issuing fines to residents who drop off prohibited items, as the sign clearly outlines what is acceptable for disposal. Council members Carman and Kreiner shared their concerns regarding access to the sight for the working residents of Cresco. Fosaaen made a motion to direct the yard waste sight back up for 90 days and reevaluate at that time. Carman seconded and it passed all ayes. The Council would like to remind residents to report any unauthorized items, illegal dumping, or out-of-town residents using the site to City Hall.
Carman made the motion to approve a Resolution Approving the Contract and Bond for the Cresco Theatre and Opera House Scene Shop for Dave’s Construction. Fosaaen seconded and it passed all ayes.
Kriener made a motion to extend the winter adjustment credits on water and sewer bills for customers running water to prevent service lines from freezing until March 20, 2025. McConnell seconded and it passed all ayes.
Bouska made a motion to approve the resolution authorizing the mayor to sign the Fiscal Year 2026 funding request form for Northeast Iowa Community Action. Carman seconded and it passed all ayes.
Carman moved to adjourn the Council Meeting at 6:40 pm. Kriener seconded, and it passed all ayes. The next regular Cresco City Council meeting will be April 7, 2025, at 5:30 pm at Cresco City Hall.
