PUBLIC NOTICE IS HEREBY GIVEN THAT THE ABOVE MENTIONED GOVERNMENTAL BODY WILL MEET AT THE DATE, TIME AND PLACE SET OUT ABOVE. THE TENTATIVE AGENDA FOR SAID MEETING IS AS FOLLOWS:

City Council Minutes

Mayor Brenno called the Cresco City Council meeting to order on May 15, 2023, at 5:30 pm. Council Members Carman, Bouska, Fortune, McConnell, and Kriener were present. No council members were absent.

Bouska made the motion to approve the consent agenda which included approval of the: agenda; claims; minutes from May 1, 2023; Tree Surgeon License for Rogne Spray LLC; Owner Occupied Housing Contractor Request for Payment #1 (final) for $8,500.00 for Jeremy Powers – Restyling Specialists; parade permit for portions of 3rd St East, 1st Ave East, Beadle Park, North Elm St, North Park P1, and 2nd Ave East for an Eucharistic Procession on June 10, 2023. Carman seconded and it passed all ayes.

Public Works Director Widell reported: (a) finished hauling sludge and the storage tanks are empty; (b) CIT will be here to clean and repair the membranes in the aeration basins; (c) will be replacing a storm sewer on 2nd Ave W between 3rd St West and 4th St West; (d) busy sending letters for lawn mowing. He reminded the public that grass should be less than six inches.

Police Chief Ruroden submitted the monthly report of Police calls for April. Waiting on evidence and additional charges may be filed.

Deputy Clerk Hill reported: (a) April financials were enclosed; (b) openings on the Airport Commission, Park Board, Library Board, Planning & Zoning Commission, and Theatre Commission. Applications are available online or at City Hall and due by May 31st; (c) zoom meeting on May 16th for our bond rating; (d) pre-construction meetings will be the end of the month; (e) the Governor singed House File 718 on May 4th. A homestead exemption is now available for taxable valuations of $3,250 for residents over 65 years old. After January 1, 2024, the exemption is $6,500 of taxable value. Applications are due July 1st to the County Assessor.

Fortune reported the Theatre Commission met and windows have been installed and they were able to preserve the arch window with the date on it. The doors have been rekeyed due to issues with keys sticking and there will be some repairs to a wall on the front of the building. McConnell reported the Park Board met and memberships are down. They are looking into ways to trim their budget.

Mayor Brenno asked for comments from the audience and there were none. Kriener made the motion to approve the flammable liquid permit for Donaldson Company Inc for an above ground storage tank. McConnell seconded and it passed all ayes.

Mayor Brenno performed the first reading of the summary of proposed Ordinance No. 506 amending Chapter 138 of the Code of Ordinances of the City of Cresco, Iowa, pertaining to street grades. Bouska made the motion to approve the first reading. Carman seconded and it passed all ayes.

Carman made the motion to approve the resolution waiving the second and third reading and consideration of Ordinance No. 506 pertaining to street grades. McConnell seconded and it passed all ayes.

Bouska made the motion to approve Ordinance No. 506 establishing grade elevations on certain described streets in the City of Cresco, Iowa, for the 7th Street West Reconstruction Project. Carman seconded and it passed all ayes.

Mayor Brenno performed the third reading of Ordinance No. 503. Carman made the motion to approve the third reading. Fortune seconded and it passed all ayes.

Carman made the motion to approve Ordinance No. 503 pertaining to water rates. Bouska seconded and it passed all ayes.

Mayor Brenno performed the third reading of Ordinance No. 504. Carman made the motion to approve the third reading. Bouska seconded and it passed all ayes.

Fortune made the motion to approve Ordinance No. 504 pertaining to sewer service charges. McConnell seconded and it passed all ayes.

Bouska made the motion to record the release of reversionary right to a portion of the property pursuant to the development agreement with BDM Developers LLC. Fortune seconded and it passed all ayes.

Bouska made the motion to approve the resolution approving electronic bidding procedures and distribution of Preliminary Official Statement. Carman seconded and it passed all ayes.

Council discussed dates that supervised Display fireworks should be allowed. Council was in favor of allowing them during the weekend prior to July 4th but were worried about allowing them a week or two later. Display fireworks require a permit approved by the Fire Chief and Council and shall be handled by a competent operator as defined in City Code. Reminder that consumer fireworks are only allowed to be discharged within city limits on July 3rd from 9 am to 10 pm and July 4th between 9 am and 11 pm. Kriener made the motion to allow Display fireworks applications for June 30 – July 4. Bouska seconded and it passed all ayes.

Chuck Reicks reported there were three retirements on the Fire Department: Kyle Kerndt 16 years; Brian McConnell 31 years; and Wayne Kerian 32 1⁄2 years. Their years of service are appreciated.

Mayor Brenno administered the Oath of Office to Second Assistant Fire Chief William Murphy.

Bouska moved to adjourn at 6:11 pm. Carman seconded and it passed all ayes. The next regular Cresco City Council meeting will be June 5, 2023, at 5:30 pm at Cresco City Hall.
