GOVERNMENTAL BODY WILL MEET AT THE DATE, TIME AND PLACE SET OUT ABOVE.  THE TENTATIVE AGENDA FOR SAID MEETING IS AS FOLLOWS:

THIS NOTICE IS GIVEN AT THE DIRECTION OF THE MAYOR PURSUANT TO CHAPTER 21, CODE OF IOWA AND THE LOCAL RULES OF SAID GOVERNMENTAL BODY.  POSTED JUNE 17, 2022.

MINUTES

Mayor Brenno called the Cresco City Council meeting to order on June 20, 2022, at 5:30 pm. Council Members Kriener, McConnell, Fortune, Bouska, and Carman were present. No council members were absent.

Bouska made the motion to approve the consent agenda which included approval of the: agenda; claims; minutes from June 6, 2022 Council meeting. Carman seconded and it passed all ayes.

Public Works Director Widell reported (a) Street Department has started chipsealing. Due to the increase in cost of oil from $14,700 to over $20,000 per load, staff is evaluating the street conditions and considering reducing the number of loads we get this summer; (b) we are still waiting for Skyline to repair the broken valve from 8 weeks ago in the digestor tank at the wastewater plant. They finally called and said they would be here this week to fix it; (c) watermain patches will be repaired this week; (d) tomorrow Pladsen from Waukon will begin hauling the sludge out of the digestor basin that is under the selenium limit.

The Mayor officiated the Oath of Office for Reserve Police Officer Kiersta Walton.

City Clerk Elton reported: (a) busy preparing claims for the final meeting of the fiscal year and preparing for year-end and audit in the second week of July; (b) pre-construction meeting for the Airport Runway Drainage Project and construction should begin this week and last less than three weeks; (c) State Code changes will require City Ordinance changes for the sale of fireworks and the UTV rules.

Fortune reported the Theatre Commission met and reported the outdoor movie and Steve McCarville Memorial Field Dedication during the Family Fun Night were well attended in East Park. Movies have been well attended. A sub-woofer was replaced and made a drastic improvement in sound. Tuckpointing and window replacements will be done in July.

McConnell reported the Park Board addressed concerns of trucks and equipment in the parks for maintenance and that staff was reminded to continue to follow safety precautions.

Bouska reported the Regional Housing Authority reported that port-outs are increasing.

Mayor Brenno asked for comments from the audience and there were none.

Mayor Brenno opened the Public Hearing for a petition to vacate the plat of the Second Avenue Condominium Complex. There were no written or oral comments and the public hearing was closed. Carman made the motion to approve the resolution approving the petition to vacate the Plat of Survey of Lots A, B, C, D, and E, Block 24, Baldwin’s Addition to the City of Cresco, Howard County, Iowa. McConnell seconded and it passed all ayes.

Bouska made the motion to approve the resolution authorizing transfer of funds for FY 2022 (June Transfers). Fortune seconded and it passed all ayes.

Mayor Brenno performed the third reading of proposed Ordinance 494 amending the Code of Ordinances of the City of Cresco, Iowa, pertaining to water rates. Carman made the motion to approve the third reading. Bouska seconded and it passed all ayes. Carman made the motion to approve Ordinance No. 494 amending Chapter 92.02 and 92.03 of the Code of Ordinances of the City of Cresco, Iowa, by amending provisions pertaining to water rates. Fortune seconded and it passed all ayes.

Mayor Brenno performed the third reading of proposed Ordinance 495 amending the Code of Ordinances of the City of Cresco, Iowa, pertaining to sewer service charges. Carman made the motion to approve the third reading. Kriener seconded and it passed all ayes. Bouska made the motion to approve Ordinance No. 495 amending Chapter 99.02 of the Code of Ordinances of the City of Cresco, Iowa, by amending provisions pertaining to sewer service charges. Carman seconded and it passed all ayes.

Bouska made the motion to approve the resolution naming depositories. McConnell seconded and it passed all ayes.

Quotes from Mehmert Tiling, Inc and Skyline Construction, Inc for the excavation contract were reviewed and discussed. Bouska made the motion to approve the quote from Mehmert Tiling, Inc and award the excavation contract for July 1, 2022 through June 30, 2023. Fortune seconded and it passed all ayes.

McConnell made the motion to approve the resolution authorizing the Mayor and City Clerk to enter into an agreement for an extension of the current Industrial Sewer Rental Agreement with AVEKA Group, Cresco Facility (f/k/a Cresco Food Technologies, LLC). Carman seconded and it passed all ayes.

Bouska made the motion to approve the resolution committing fund balance resources for General Funds and Special Revenue Funds (GASB 54). Fortune seconded and it passed all ayes.

Kriener made the motion to write off three uncollectible customer accounts for FYE June 30, 2022 for a total of $248.01. McConnell seconded and it passed all ayes.

Bouska made a motion to change the July 4th Council meeting date to Wednesday, July 6, 2022 due to the holiday. Carman seconded and it passed all ayes.

Carman made a motion to approve the recommendation of the respective Boards and Commissions and appoint members for terms of three years expiring 6/30/2025 as follows: Airport Commission to reappoint Gerald C Ferrie; Library Board of Trustees to Reappoint Christine Lueschow and appoint Kay Reis (to replace Patsy Bronner); Park Board to reappoint Holly O’Brien and appoint Chelsey Hovden (to replace Kris Riley); Theatre Commission to reappoint Jon Hayek, appoint Kelly Bartling (to replace Lesa Riedel), and appoint Ann Seebach (to fill Tara Henry position expiring June 30, 2024). McConnell seconded and it passed all ayes.

Council discussed dates that display fireworks should be allowed. Council was in favor of allowing them during the weekend of July 4th but were worried about allowing them a week or two later. This year they agreed to allow the July 9th request but would not allow them on the 16th. The Council will set dates each year for the dates allowed based on the day of the week that the 4th falls on. Display fireworks require a permit approved by the Fire Chief and Council and shall be handled by a competent operator as defined in City Code. Reminder that consumer fireworks are only allowed to be discharged within city limits on July 3rd from 9 am to 10 pm and July 4th between 9 am and 11 pm.

Carman made the motion to approve the Permit for Supervised Display of Fireworks for: Alan Lewis, 808 Vernon Rd on 7/2/22; Bryan Sheehy at H&S Motors on 7/3/22; Josh & Amy Bollman, 1207 3rd St SW on 7/9/22. Kriener seconded and it passed all ayes.

The report from Dixon Engineering was reviewed showing the adhesion testing results on the water tower. Unfortunately, the bowl of the tower failed the adhesion tests so instead of recoating the tower, we will now have to sandblast and contain it, as well as paint the outside and possibly inside. That will increase the cost of the project so now it could cost about $780,000. Council agreed to have Tim Dixon attend the July 18th Council meeting to explain the revised project and anticipated timeframes to maintain the integrity of the water tower.

Carman moved to adjourn the Council Meeting at 6:04 pm. Bouska seconded and it passed all ayes. The next regular Cresco City Council meeting will be Wednesday July 6, 2022, at 5:30 pm at Cresco City Hall.
