PUBLIC NOTICE IS HEREBY GIVEN THAT THE ABOVE-MENTIONED GOVERNMENTAL BODY WILL MEET AT THE DATE, TIME AND PLACE SET OUT ABOVE. THE TENTATIVE AGENDA FOR SAID MEETING IS AS FOLLOWS:

NOTICE OF REQUEST FOR VARIANCE
TO ALL PROPERTY OWNERS WITHIN 250 FEET OF ZACHARY J. STEINMETZ PROPERTY AND TO OTHER PERSONS WHOM IT MAY CONCERN:
An application for a variance to the City Zoning Ordinance has been filed with the Board of Adjustment by Zachary Steinmetz.
The property is situated in the R-2 zone and is located at 217 4th Ave SE in Cresco, Iowa.
Legal description: LOT 4 WOODWARDS SUBDN 1/2 BLK 4 BEADLES ADDN.
The request, if approved, would authorize the construction of a shed with living quarters.
The Enforcing Officer was required, under the provisions of the Zoning Ordinance, to deny the permit because the garage will encroach on the west side set back by four feet (4’ 0”) and the east yard by two feet (2’ 0”). City Code requires seven (7) feet.
However, the Board of Adjustment, under certain conditions and safeguards, may have the authority to grant the request.
The Board of Adjustment will hold a public hearing on Wednesday November 6th, 2024 at 7:00 P.M. in the City Hall, at which time you may submit your views on the matter in person, by writing or by representative. A copy of the application for variance is on file with the City Clerk.
You are further notified that any persons not objecting in writing or at said hearing, shall be deemed to have consented to the granting of the requested variance by the Board of Adjustment.

MINUTES
MINUTES OF THE CRESCO, IOWA BOARD OF ADJUSTMENT
Chairperson Dohlman-Govern called the Cresco Board of Adjustment meeting to order on November 6, 2024 at 7:00 pm at City Hall.
Board Members present were Emily Dohlman-Govern, Richard Holten, Dale Ernst, Bob Story, and Alison Holten
Other guests in attendance were Zach Steinmetz, and Public Works Director Dave Brenno.
Meeting was called to order by Chairperson Emily Dohlman-Govern.
Alison Holten motioned to approve the agenda, Emily Dohlman-Govern second, motioned carried all ayes.
Emily Dohlman-Govern made the motion to approve the minutes from July 16, 2024. Alison Holten second, motion carried all ayes.
The City of Cresco mailed a notice to all property owners within 250 feet of 217 4th St SE, and placed a notice in the Cresco Times Plain Dealer. The City did not receive any correspondence regarding this variance request.
The Public Hearing was opened and discussion was held regarding a variance application from Zach Steinmetz.

Emily Dohlman-Govern made a motion to deny the variance, Richard Holten second the motion. Motion to deny the variance carried all ayes.
WHEREAS, an application for variance was filed with the board, and,
WHEREAS, in accordance with the provisions of the Zoning Ordinance of the City of Cresco, Iowa, notice of hearing was given and proof of said notice of hearing, in accordance with said statute is now on file herein, and this Board having jurisdiction of the subject matter and jurisdiction of the property and parties concerned, finds that the variance should not be granted as requested in said application.
Alison Holten moved to adjourn at 6:30 p.m. Richard Holten second, and it passed all ayes. There are no future meetings scheduled at this time. The board meets on an as needed basis.
